Can dramatic(movie) format infringe non-dramatic(essay or explanation) literature format in copyright law? (this means that the non-dramatic (essay or biography or explanation) was created first).

For instance someone made a literature based on his new invention of form of expression for instance like Ben 10 its omnitrix as the literature (essay or biography or explanation how the omnitrix works and is used) then someone created a drama (movie) for it without the consent of the literature inventor of Ben 10. The drama looks like the ben 10 series.
