Sorry this post has a long intro.
Recently I was involuntarily terminated by my employer. They extended me COBRA benefits, and I applied. When it came to light there was new legislation requiring them to pay for my COBRA (and i reimburse 35%) they suddenly did not qualify to extend COBRA (fewer than 20 employees for more than half the previous year). So I applied for state continuation which abides by the similar law. They then sent me a tricky sounding letter to sign, and it said I accepted full responsibility for the full $1100 a month cost of state continuation. Because I am only responsible for 35% I wrote it into the letter that they were responsible for the full $1100 and I was only responsible for $385.14.
Since then they have come after me two more times with funny figures saying I owe them money - supposedly they weren't withholding enough and they gave me a spreadsheet. I was not provided any statements, only a spreadsheet.
The spreadsheet shows an increase in my premium for the month my son was born. However, we did not add him to our insurance for two pay periods after his birth.
How can I acquire the insurance statements that show how much my plan really costs and how much I'm being billed? All I have are my paystubs, but I want to know how much my plan really costs because that information is not available on my insurance's website.
If I am wrong, then I am wrong and I owe them money. But given their history of behavior I have reason to doubt their honesty.
If I can prove they have been doctoring figures, what legal recourse do i have? Would it be worth a lawsuit?
