Can a mechanic keep my car and make me pay if the insurance Co. told him to

repair but later denied the claim? PLEASE HELP...

My car was vandalized coincidentally 1 day after I renewed my policy. The insurance co. denied my claim saying I couldn't substantiate the loss or I can't prove when the vandalism actually occurred. I told them it shouldn't matter if it happened 1 minute after I renewed the policy, the fact that I was covered at the time, and the police report is consistent with what I told them happened, they have to cover the loss.

The claims manager told me I he didn't believe me and this type of insurance fraud happens all the time. So I filed a complaint with the Illinois Dept. of Insurance and they are investigating it.

As for my car... the insurance company had the car towed to their mechanic 2 months ago when the vandalism happened. I was going to have the car towed to a friends garage until I could afford to repair it. Its drivable but the windshield is bashed in.
The mechanic told me he has already done the repairs on the car because the insurance company gave him the OK to do so when the car first arrived and now they're not going to pay him.
So he's saying he wont give me the car until I either pay him for the repairs, ($2000) or pay storage for the time the cars been at his shop $45 a day for 2 months so about $3000. Then he says he may even take all the parts back of and return the car to its original condition when it first got there, and still make me pay him for storage.

How can I get my car? If I had the money to pay him I would, just to get this whole thing over with, but I don't have the money. Can he do this? Can he make me pay even though I never authorized him to work on the car? Can he keep my car until he gets his money?
He wants me to come to the shop and talk to him about paying him, what should I tell him? PLEASE HELP
 
Sounds fishy to me. I think, however, that you should talk to an attorney first. You have a right to choose where you are going get repairs done - you don't have to use the insurance company's garage. Your insurance company basically stole your car when they towed it to a garage of their choosing. That would be the first avenue I'd explore with a lawyer. This is all in light of the fact that you have police report which you say substantiates your claims.
 
yes mechanic can keep it til someone pays for the work best you get a lawyer to work it out id sue... your right it was covered when you payed them money and police report is consistent then he dont have a case and you win
