...not even show up? What if he did? My son is on probation. His P.O put him in jail 2 months ago due to a violation (was caught drinking). He did not however revoke him. My son, I'll call him Nick, was due to have his court date for this yesterday. His P.O and Public Defender did not show up. So the Judge set it for this morning. I decided to call Nick's P.O and see if he would be there. His answering machine said he'd be gone on vacation till next week. I didn't think they'd go through with the court date then and had to work any how so didn't go. My son called me this morning and said they brought in a different P.O that didn't even know his case very well and his Public Defender didn't even show up again. He had no one to represent him. The DA said they thought he had sat long enough (not sure what all this other P.O said, my son was not able to talk long) but the Judge said no. He wasn't going to count the time Nick has already sat and that he is to sit another 5 months. Nick can't believe this, I can't either and feel his rights may have been violated. Have they? Can the Judge rule like this no matter what? Or does Nick have the right to ask for a new court date since his P,O was different and no was there to represent him? Any help would be greatly appreciated. And if you can find any rights in writing on this on the internet please, please let me know where you saw them so I can print them off.
