I know it would seem to be a stupid move, but in some instances it could be helpful.

I dont mean before the sol time runs out-----i mean if it could mean you would be able to plea to a lesser charge if you waive the fact that the sol time ran out
@ citi---if you were charged w/first degree murder because the statute of limitations had run its course for the lesser degree of murder charges, than i would say it might come in handy for that person.

Because enough evidence might be presented to the jury to show cause for the murder trial, and with the sol running its course on the lesser charges, it would be first degree murder to the jury or nothing----all in or all out
The lesser charge would be second and third degree murder or manslaughter versus first degree murder
Because the jury might decide to convict on the first degree murder charge, while knowing it should be a lesser charge, but given the choice to convict or walk, they would most likely convict..
