Can a defendant lawyer file a motion in a divorce?

The plaintiff's lawyer stopped responding to the defendant's lawyer letters. They last time they (plaintiff's lawyer and defendant's lawyer) was December of last year. The plaintiff's lawyer has just been ignoring the other lawyer. The reason for this is because they don't have a solid case as they thought because the plaintiff and her lawyer has evidence. If the defendant lawyer file a motion, what will that do? How long will it take to get some kind of date to see a judge?

Letters are not court documents or actions. If the case is being delayed unreasonably, the defendant's lawyer needs to file a motion, whether to dismiss or to get some discovery completed.

NJ may still be a for-cause state, in which evidence for the grounds for divorce must be presented. Most states now have "no-fault" provisions in which the parties merely need to agree the marriage is irretrievably broken down.

If your lawyer is not responding to you or not explaining what's going on, get a new lawyer.
