Can a car dealership tell you a car is there when it really isn't?

I contacted a car company asking if a car was still there.

Then i bought a carfax report and it looks like the car was put on sale on February and the title was already signed over to a second owner by early June. However, someone called me back today and left me a message saying that it was still available

That's very fishy. Can a car dealership tell you a car is there when it really isn't? What can I do about it?
