Can a bank pull out a credit report without an approval from its customer?

Recently, I was contacted by a customer representative from my old bank. She was asking me if I still want to keep my savings account from them. I told the customer representative that i am not interested in keeping my account for now due to the fact that the said bank is 30-40 miles away from me (this is the closest credit union location for this bank). She advised me that I have to make a written notice stating the closing of my account. I told her I agree and will send it asap.
The same day I had this conversation with the bank rep, I was notified by my identityguard account that my old bank/credit union pulled out my credit report looking as if I applied for a loan from them. I immediately called the bank and asked them whether or not they pulled out a credit report for me. They said they did. I ask them why did they pull out a credit report without my approval. They said its their policy to check credit report every now and then? Not satisfied with the answer I got, I called my identityguard representative and ask them what are the repercussions for this action/s. The rep told me that it would significantly affect my credit score by taking away 20-30 points. I told the rep that it is big amount of score being pulled from my credit score considering I did not request this transaction. The rep advised me to talk to my bank about the situation. I then called my bank and i asked them if anything could be done regarding the matter and they said it was already done. I was also told that when I applied a savings account to their bank, I agree to the terms and condition that my credit could be checked every now and then. After hearing this argument I immediately ask the bank to provide me with this written agreement that I signed from them, since this will be in my application packet or will be in my records. But until now they cant provide me with it. Can someone explain to me what is happening?. I'm not really sure if I should continue fighting this or do I have the right to sue them or do I have the right to complain about them. Whose fault it is? Is there anybody at fault? how can I resolve this? Thank you in advance.....
