can a 18 yr old be charged with statutory rape of my 16 year if I know they are

having sex we li? he lives with us now. I know they are having sex can he still be charged with statutory rape if I have knowledge of the sexual relationship
 
Depends on the laws in your state. In California, an 18 year old can have a sexual relationship with a minor, provided they are within two years of each other. And, that makes sense. Let's say a 17 year old and a 16 year old are in a sexual relationship (which is perfectly legal) and the 17 year old turns 18. It doesn't make sense that the 18 year old would then be guilty of statutory rape, when nothing about their legal relationship has changed except that someone had a birthday.
 
depends on the state! What are you thinking? I am 23 and at 16 I had no idea what I wanted! She needs to be independent go on dates! Have friends over!
 
What state do you live in? that weighs heavily on if it is Statutory Rape (if your state has an age of consent law older than 16)

In most states there are "romeo and juliet" laws that protect young people from such a charge. Statutory rape laws are designed to protect minors from the predations of much older people, not to prosecute teenage boys for having sex with teenage girlfriends.
 
Depends on State law.

The most common age of consent in the USA is 16, which means that the sex is legal anyway.
