Buying unlocked phone

When I first started using my pearl, I signed a 2 year contract with t-mobile. Now I would like to upgrade my pearl to a curve. I cannot get any upgrade discount and I have to pay the full retail price for the curve which is $450. So I was thinking maybe I can unlock my pearl first and sell it, then buy a unlocked curve on ebay.

Just curious if this is against t-mobile policy in any way. Say if I have any problem with the curve that i bought from ebay. Can I still call t-mobile customer service to ask questions about the device?
 
If you have a problem such as a warranty issue, defective phone or whatnot, they would probably be of no help. However, you can contact the owner and see if he can call them and sort it out if it is still under warranty. If you have a simple question just ask anyone at the stacks!

You can get an unlocked curve. However if it isn't t-mobile's and you are on myfavs they may remove you off the myfavs service. They discourage that. They have no problems answering certain questions about the device but when it comes to warranty issues you won't be able to exchange it. ~via BB (wap.rabroad.com)~

You can however purchase ANY phone from any vendor, and call tmo within 7 days of the purchase and let them know you got it from a dealer other than a tmo corporate store and add insurance. S or 5 bucks a month covers lost, stolen, water or physical damange. Well worth it for a curve (110 dollar deductible gets you a brand new phone, in most cases the very next day).

As a side note, Nokia have a nice policy, if the dealer sells nokia, they will have to offer warranty repairs for it. The bill goes to nokia anyway.
