Books/Authors,Are The Mickey Mouse Ears Copyrighted/Trademarked?

I'm pretty sure the Mickey Mouse ears from Disney are trademarked but are ALL mouse ears trademarked by Disney? Like, ANY type of mouse ears that are black, too? Or do they have to have the words Disney or Mickey Mouse Club, or be the exact same shape/demensions to become an infringement? What if you wanted to use mouse ears for a film or TV show that was not in the same genre as the Disney genre, ect., different characters?

Thanks so much! I meant at least BLACK, even if the shape of the ears are slightly different?
 
The round flat black disks are trademarked. If you wanted to use realistic mouse ears, which are gray, triangular, and curved, then go for it. The trademark is more general than copyright not needing to be a specific image.
