I have a shop and its timings are
Mon-Sat: 9am-1pm and 5pm-9pm;
and Sun: 8am to 1 pm.
I want to change the timings to
Mon-Sun 8am-1pm and 4.30pm-8.30pm.
From my understanding of the Bombay Shops & Establishments Act,
1. The spread-over cant exceed 11 hours a day.
2. Total hours of work cannot exceed 48 hours a week.
What I need help with is-
a) So even if I give a weekly off, my employees would be working for 54 hours a week. So does this mean that mean I got to pay them for 6 hours of overtime i.e double the rate for 6 hours?
b) Is it allowed to make them work for 9 hours (with a 3.5hour break in between) in one day as long as in a week it would not cross 48 hours?
c) Also, if the employees are provided with rotating offs (1 holiday anytime during the week), would I need to pay them double for working on a sunday?
d) How many public holidays in a year are employees entitled to (considering the shop operates 365 days a year)?
Could someone please help me with this!!
P.S: I do not follow most of the guidelines from the Act at the moment as I was unaware about it..I wish to make some changes and hence am asking for your help. Thanks in advance!
