I am 20 yrs old. I was the back seat passenger of a car that was pulled over for headlight that was not working. The police pulled the driver out of the car and gave her a breathalyzer, which she had no alcohol and passed all of the test. The police were going to let her go but came and asked everyone else for identification. We provided them with it. They seen i was underage and pulled me out of the car and made me take a breathalyzer. could i have refused it? The officer asked me was i drinking with everyone in the car? i told her no they had just picked me up from home. she soon arrested me. i have to go to court for a misdemeanor. could this stay on my record? should i have a lawyer represent me? the other two girls including driver were both arrested for providing to a minor and we never received a ticket for the headlight being out. I blew 0.05 which i should have not been drinking at all. I clearly stated to the cops the girls were not drinking with me. All of our tickets said different things. The cops tried making me admit i was at a local bar drinking but i was at home drinking.
