army paternity leave regulations?

5. PATERNITY LEAVE WILL NOT EXCEED 10 DAYS, AND MUST BE TAKEN CONSECUTIVELY AND WITHIN 45 DAYS AFTER THE BIRTH OF THE CHILD. THIS AUTHORIZED ABSENCE (NON-CHARGEABLE PATERNITY LEAVE) IS APPLICABLE TO SINGLE PREGNANCIES, TO INCLUDE THOSE THAT RESULT IN MULTIPLE BIRTHS (TWINS, TRIPLETS, ETC.). DEPLOYED SOLDIERS HAVE 60 DAYS AFTER RETURNING FROM DEPLOYMENT TO UTILIZE THE 10 DAYS OF PATERNITY LEAVE. IF NOT USED WITHIN THE ESTABLISHED TIME FRAME LEAVE IS LOST


we recently had a baby (on a thursday) and my husbands captain told him to turn in his leave paperwork on monday and his 10 days would start. he did, everything was signed, and he got a phone call from his first sergeant the next day saying his leave was changed to start the day that I had the baby "since that was the regulations" (above, it states my husband should have anytime within 45 days to start the leave)

first of all, is that something they can do? change leave dates after they are signed off on?
second, i can't find anything in the ACTUAL regulations regarding paternity leave. is it specifically in there?

and yes, i know, when you're in the military you're a soldier first and a husband/father second, but I have a hard time believing that it's to that extent. Especially since the captain was the one who explained everything to us and told us the dates, etc.
