A few years ago a petition to dissolve a marriage was filed in Iowa. The mother then took the child to another state without a court order and against the wishes of the father. The father then followed in order to be closer to the daughter, and they now have joint physical custody.
I know the father could have alerted the court at the time and asked for the daughter to be returned, but hind site is 20/20. That was 3 or 4 years ago.
In Iowa, is there an automatic injunction in place when you file for divorce that precludes either party from taking the child out of the state? I know some states have this automatic injunction but can't find info on Iowa.
Is it okay that she moved because he didn't ask the court for an injunction? Or was there already an automatic injunction?
Again, it's too late to do anything about it now, but having this knowledge would be very useful for the future.
