Am I eligible for a new cell phone (AT&T) ?

I have a sony ericsson z750a. I got the phone in the middle of september and kept having problems with it. It would turn off randomly and the texts wouldn't leave the outbox. So I got the refurbished phone in February (?) since it was in the warantee thing. This phone stopped sending texts also, so I brought it to the store billions of times.
In total, I've gone through 3 sim cards in the past month, and had the whole phone reset 4 times. I DO NOT HAVE INSURANCE. Each time I go they don't know what's wrong with my phone.

Can I make at&t give me a new phone, since I pay for unlimited texts and clearly I cannot send texts?
What should I do to get a new phone WITHOUT paying?
 
Keep going in a telling them you've got problems with the phone. Or try calling customer service. If you do it enough, they'll eventually give you a different phone.
