Please go easy on me; this is the 1st time I have been charged with anything.
This happened in Scotland UK. And I do not understand the law or court stuff.
18 months ago I was involved in a VERY small car crash, no injuries. I had my 8 months pregnant wife in my car and my 15 year old son. I got out he car, and the passenger was running at me threatening me (I won’t use swear words) the Driver then shouts similar things out his window; in a split second panic i kicked the other car door as I felt they were both coming for me to attack me, My partner and 15 year old son thought this also. then the passenger of the car hit me, I hit him, then both of them laid into me to the point I needed hospital treatment. I am a disabled lad with a young family (2 daughters) and I had just broke my ankle (I break bones a lot due to my disability)
I get in my car and flee the scene and go RIGHT to the police station to report I had been assaulted. 20 minutes later 2 police officers come in and charge me with assault!!! My pregnant wife about fainted. The police were brilliant with me. They explained because there was 1 independent witness (at rush hour on a busy main road) that was why I was being charged. The statement from the independent witness is "The man got out of his car, kicked the other car punched the driver, then drove away) I have 6 pictures of my injuries, was hospitalised for half a day, they done x rays on my back where I was hit several times with the size bumper from the car that hit me. I still receive tablets for this injury. The case has been called 4 times now; 2 times I had to get a "soul and conscience letter?" as my Dr said I was in no state to stand Trial. the next time the main complainer never showed up.
My lawyer thinks I will get 2 not guilties based on the fact the independent witness never seen me getting a good going over, But why with all this evidence for me, and 2 witness’s, pictures of my injuries, Hospital and Dr's letters...are the Crown/PF still going ahead with this?
I am really worried; My Lawyer keeps saying it will be ok.
But with my illness and pain, I can’t cope.
I take 40 tablets a day for pain on a bad day. The disability has gotten worse to the point (it’s been 18 months) I had to move to a specially adapted disabled house.
Why am I the bad person here?
And what is the likely outcome?
The police report says "I got out of my car, my car registration number, and kicked their car MY REGISTRATION number!! lol
Again the police were terrific with me, they gave my pregnant wife a lift home, and I was charged and out the door in less than half an hour. The policeman dealing with me advised me to go out one door and into the next and press charges against the 2 chaps in the car. We were not allowed. We presented ourselfs (my family) again 1 hour later to ask to give statements and were told we could not. I am so confused and worried and anxious etc
Am I worrying to much?
