A Supervisor discusses her team members in her stand up act. Is this Misappropriation?

I work at a smoothie store in California and recently discovered that one of my supervisors does stand-up comedy on the side. I was distressed to discover that she talks about me and my fellow co-workers in her act and refers to us in her act as "The Jamba Gays" and tells jokes and stories about us, often referring to us by name. I have not consented to this, and most of my co-workers have no idea that they are even being talked about. ALSO, Jamba has a non-disclosure agreement that all employees sign that states that "No employee while working for Jamba Juice or at any point after shall disclose publicly or privately any matters concerning the operations or well being of the company or any party under it's employ, to any 3rd party."

Do my supervisor's first amendment rights outweigh my rights and my co-workers' rights to privacy, or do I have the right to sue for violating my right of publicity or for misappropriation of my name?
