3rd time a charm hopefully?

Hello everybody, hope everyone had a good holiday. I have had a microdisectectemey, i had a fusion with 4 screws in july of last year. I was still having problems with leg nurabness and crucial back pain. Mind you this is a workmans comp case. My surgeon released me back to full duty work without even telling me, i learned that from my attorney. So i had to get a second opinion, i found out the disk above the one that was fused had herniated. So my new doctor wants to fuse that disk, workmans comp dropped me, they stopped paying me in july. So now i am in court trying to get them to pay my back pay, and pay for the surgerey. I didnt know that my first doctor was on the insurance companies payroll, wow that florred me.So i am in court and i am miserable, there trying to say it wasnt a work injury, the disk thats herniated now. They are a mess, so if any feed back please Help. There not paying for anything.
 
I hope you have a good attorney! I am going through a VERY similar situation. I had a fusion in 2008, and then the disc above it failed (this is very common) so I had another fusion in 2009 - and my fusion failed. I also have a workers comp case and to make it more complicated I had to relocate due to my husbanRAB job and now workers comp is trying to stop payments. My neurosugeon has been recomending a third surgery since April of 2010 and workers comp is only concerned about discontinuing benefits. I have a failed fusion, bad disc, and compressed nerve ~ So I too, am hoping that the third time is a charm.. It is extremely frustrating and I sincerely feel for ya.. Don't give up! That's what they want.. Keep fighting and make sure you have a good lawyer and a good doctor. Good luck and keep me posted - sounRAB like we are in the same boat. I have a workers comp hearing on monday and I have my fingers crossed!
 
I just want to wish you both the best of luck in this battle. What a shame that wc works for the employer and not the employee as was the original intent, if I'm not mistaken. Too often the employee is left to battle alone while the company has the whole system behind them.

I hope you both are able to make them pay and pay dearly! It would be a great start to this New Year.

The IME dr. doesnt agree with my neurosurgeon so now I have to go for another evaluation with a different dr. Of course this will take several months to all take place because everyone moves like slugs.. I am so frustrated I want to scream!! And yes, in the meantime workers comp is trying to stop my benefits. It's such a terrible system. Have you heard anything from your attorney? Have you found a dr. yet?
 
Well i have another doctor, he wants to do the 3rd surgerey. My attorney has a court date friday the 7th, i have had a deposition with my new doctor. So im just waiting for the insurance company to say something. In the meantime i am not getting paid anything, so that sucks. But i will not give up.
