2008 jeep patriot jumping gears from 6th to 1st while moving.?

My jeep patriot (2008) has jumped from 6th to 1st while I was driving and would not manually (slap stick) shift out. I had to pull over and put it in park and then back to drive to get it out of 1st. I have had issues from the beginning with it being really jerky when releasing the gas peddle to start coasting down and at times accelerating. I can feel it dropping gears, which I shouldn't since its a cvt transmission. Yet its not always like that, so its never consistent. When it is acting up my RPMS also sky rocket when trying to accelerate, and it acts like I'm hauling a trailer behind it, really sluggish. But the dealership keeps telling me they can't find anything wrong with it. Plus one day it wouldn't start twice, then they did an update in it, but it just seemed to get worse instead of better! What's wrong with it and what can I do? Can I get the dealership to take it back without losing my money, I've only had it about two months now.
 
This is precisely the reason why it is not worth it these days to purchase a car with an automatic transmission. There are a lot of electronic components involved, and when problems arise, they can be very tricky to diagnose.
I would go back to that dealer and tell them to make it right. If they won't, make them take that POS back. And don't take no for an answer.
 
this vehicle should still be under manuf. warranty. Take it to any Jeep dealer.

Does your state have a Lemon Law? check into that.
