2003 mazda Protege dies after losing oil drain plug 6 days after oil change?

the mechanic shop that changed the oil claims not to be liable because it has been 6 days and approx 200 miles. Are they??? The car was towed to a dealership where it was noted the drain plug was missing and the oil COMPLETELY gone. The motor is seized up and dead...HELP!!!
I must edit my question. My oil light never came on until the began to stall and stop. there was no leaking or knocking or any other sign that anything was wrong until the light came on, the speed began to slow and the car slowly died. I barely had time to pull to the side of the road. When the tow truck driver lifted the car, he saw the plug was missing and the oil was empty. The dealership said the motor was damaged and needed to be replaced. Is the service station that originally changed the oil liable for damages and repairs?
