Don't buy it from Walmart. I bought one from them once and it was a piece of crap. My friend got in an accident on his when it fell apart right out from under him.
If there was a breach of written or verbal contract, then yes. Are you suing for the return or the guitar or the monetary value? If it's for the money, it can't exceed $5000.
