you can, but the update is based on product code, so you still won't be able to update it until nokia releases it. you can't put the e61 f/w on the e70...i don't think you can. you can try.

No, flashing the firmware will NOT unlock the phone. It is next to impossible to unlock a 3 phone because of their unlocking policies requires the original phone owner to unlock and a large sum of money to 3 (upwards of 100 pounds).
