My father recently passed away and he left us with a house that has about 40,000 in home equity. Do we have to go through probate to split the home equity with our mother and us the kids? And he left us with no will. Also how long will the probate process take, approximately?

I have a sizable equity in my home and was wondering if my kids will inherit my home or will it go through probate? What if i transfer the deed of the house to my kids? Will that gurantee my house getting transfered to my kids? ...Thanks in advance.
