Does a seller have to send a sim card with a cell phone on ebay? if they don't how hard would it be to get a card and how expensive... im looking at a t-mobile gravity...

these 2 phones come without contracts.... my aunt says that when i get the sprint they wont activate it for me unless i get the contract which i dont want. Is this true should i get the t-mobile or would they be just as likely to do the same. I wanted a phone that wouldn't cost me a couple...
