Are pocket bikes legal?

I was wondering if a 49cc pocket bike is legal in Montana. I was wondering cause my friend said it wasn't but my dad has a little 49cc engine that he attaches to his bicycle and thats street legal; so I thought maybe a pocket bike would be legal to....
 
yes it i bought a pocket bike off of usapocketbikes.com they are really fast i whey nlike 90 pounds so i go like 40- to 45 tops have fun.
