naked pictures of children do not equal pornography, and besides, the context of this photo isn't explained.
last time i went to germany i had to delete about 150 pictures of my trip to a lake because there were naked kids running around everywhere,as well as adults. no way in hell was i going to risk going to jail over a picture of myself and some friends with a naked 5 year old streaking around in the background

To be considered pornography, the child must be engaged in some sort of lewd behavior. Of course, that can encompass many things, but simply standing naked doesn't cut it.
